Former Virginia Attorney General Ken Cuccinelli (R) said he expects the Virginia Supreme Court to issue a unanimous 7-0 ruling striking down a newly approved congressional redistricting map that was narrowly approved by voters earlier this week.

Cuccinelli made the prediction during an interview with CNN’s Jake Tapper. He pointed to long-standing Virginia legal precedent requiring constitutional amendments to pass through two separate legislative sessions with a general election in between, a process he said was not properly followed.

“The vote in a referendum is part of the legislative process. It’s analogous to a governor signing a bill,” Cuccinelli said. He added that the timing of the legal challenge is consistent with Virginia legal history, noting that the General Assembly “blatantly ignored” constitutional requirements for amending the state constitution.

 

 

 

 

Cuccinelli also agreed with the lower court judge’s assessment that the ballot language was “flagrantly misleading.” He expressed confidence that the state Supreme Court would overturn the measure, likely in May, due to these foundational procedural issues.

The former attorney general noted that supporters of the measure would need to prevail on four separate constitutional challenges to keep the map in place.
